These Terms of Service ("Terms") are a binding agreement between you and PlainSight — Insightful Actions ("PlainSight — Insightful Actions," "we," "us," or "our") governing your access to and use of the web application at plainsightai.app and related features (the "Service"). PlainSight — Insightful Actions is not affiliated with, endorsed by, or related to any other company using the name "PlainSight." If you use the Service on behalf of an organization, you represent that you are authorized to accept these Terms for that organization.
You must be at least 16 years old (or the age of majority in your jurisdiction, if higher) to use the Service. By using it, you represent that you meet this requirement and that the information you provide is accurate.
PlainSight analyzes spreadsheets and transaction data you provide — in your browser — to produce plain-language summaries, industry benchmarks, narratives, charts, and downloadable reports. The Service is offered on an evolving basis: we may add, modify, or discontinue features at any time, and newer features may occasionally change or be unavailable. We aim for accuracy but do not guarantee that every output is complete or error-free.
Some features require an account, created and secured through our authentication provider. You are responsible for maintaining the confidentiality of your login and for all activity under your account. Notify us promptly of any unauthorized use. You may create a free account; certain features require a paid plan.
The Service offers a free tier, one or more paid subscription plans ("Pro," billed monthly or annually), and one-time purchases ("Report packs"). Payments are processed by our payment processor, Stripe; by purchasing, you also agree to Stripe's terms. Key points:
You retain all rights to the data and files you analyze. As described in our Privacy Policy, that data is processed in your browser and is not uploaded to or stored by us (aside from the opt-in ledger-photo feature). We claim no ownership of your content and do not use it to train AI models. You are responsible for ensuring you have the right to use any data you input.
You agree not to: use the Service for any unlawful purpose; upload content you don't have the right to use, or that infringes others' rights or privacy; attempt to breach, disrupt, overload, reverse-engineer, or circumvent the security, access controls, or usage limits of the Service; resell or redistribute the Service without permission; or use the Service to build a competing product by scraping or bulk-extracting it. We may suspend or terminate accounts that violate these Terms.
The Service produces informational analysis and industry "rules of thumb." It is not financial, investment, accounting, tax, or legal advice, and no analyst-client or fiduciary relationship is created. Benchmarks and AI-generated narratives are estimates that can be incomplete or wrong. Always verify important figures against your source records and consult a qualified professional before making financial or legal decisions. You are solely responsible for decisions you make.
Certain features use AI to generate benchmarks, narratives, recommendations, and to read ledger photos. AI output can contain errors or omissions and should be reviewed for accuracy. We do not warrant that AI output is complete, current, or fit for any particular purpose.
The Service, including its software, design, text, branding, and the "PlainSight — Insightful Actions" name and logo, is owned by PlainSight — Insightful Actions and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your own business or personal purposes in accordance with these Terms. All rights not expressly granted are reserved.
The Service integrates third-party providers (including Clerk, Stripe, Anthropic, Vercel, and Google). Your use of those integrations may be subject to their terms, and we are not responsible for third-party services.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT RESULTS OR OUTPUTS WILL BE ACCURATE OR RELIABLE.
TO THE FULLEST EXTENT PERMITTED BY LAW, PLAINSIGHT — INSIGHTFUL ACTIONS AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR US $50.
You agree to indemnify and hold harmless PlainSight and its operators from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the Service, your content, or your violation of these Terms or applicable law.
You may stop using the Service and close your account at any time. We may suspend or terminate access if you violate these Terms or if necessary to protect the Service or other users. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnification) will survive.
These Terms are governed by the laws of the United States and the State of [your state], without regard to conflict-of-laws principles. You and PlainSight agree to the exclusive jurisdiction of the state and federal courts located in [your county/state] for any dispute not subject to other agreed dispute-resolution terms.
We may update these Terms as the Service evolves. When we make material changes, we'll update the "Last updated" date and, where appropriate, notify you in the app. Continued use after changes take effect means you accept the revised Terms.
